Terms & Conditions

The Civil Aviation Authority has outlined laws that I have to comply with for the safety of the public and our respective clients. The terms and conditions are relevant to every flight that is conducted by Hawk Aerial Productions. It is advised to read these carefully for a full understanding of the terms of service and how they relate to your project.


PLANNING

To ensure that the drone operation is safe to carry out. Adequate planning is required including checking airspace before any flight can go ahead. This is one of the key aspects to ensure no incidents occur.


COPYRIGHT

Copyright on all footage and legal title to all goods is retained until full payment is received. The footage is captured with the intention that it is solely used by the client. Hawk Aerial Productions retains the right to use this footage for the purpose of promotion.


INVOICE PAYMENT

All invoices are due for payment within 30 days, unless agreed otherwise in advance, following the date of delivery of the invoice as stated on as well as in the name of the invoice. I reserve the right to charge interest on all overdue invoices under the Late Payment of Commercial Debts (Interest) Act, 1998 at a rate of 8.5% above the Bank of England’s base rate set at the start of each period.


WEATHER ALTERATIONS

The weather constantly changes and this can cause flights to be delayed or cancelled. Hawk Aerial Productions will not be held liable if these changes occur. Generally I would advise for clients to have a back up day in the event that the original filming date is cancelled.


PILOTS FINAL DECISION

In the event that there will be risk to the public or property due to unreasonable demands. The pilot has the right to cancel the flight and discuss with the client an approach that will ensure safety is upheld to achieve the desired outcome for the project.


TRAVEL CHARGES

Travel is charged at 45p per mile from the office to the site of operations.


CAA FLIGHT LIMITS

Due to restrictions set out by the CAA, there is a maximum altitude of 400ft (Above Surface Level) and horizontal distance of 500m. This means that if your project requires distances that exceed these limits. An application must be submitted to the CAA for approval which can take up to 28 days. This additional time is something to consider if your project requires these limits to be exceeded.


AIRSPACE RESTRICTIONS & PERMISSION

There are some occasions where a project requires aerial photography & filming that takes place in restricted airspace. If this is the case, further permission is required from the CAA to legally conduct these flights. It is advised to allow at least 28 days to have these permissions approved. It is advised for our clients to keep this in mind for projects that require these permissions.


OPERATIONS MANUAL

The CAA issues the operational authorisation based upon the Operations Manual, which is carefully reviewed upon application. If in the event that any of these rules will be breached. The pilot will inform the client and discuss options.


LOCATIONS PLANNING

With regards to locations, if your project requires multiple sites for aerial footage during the same day. This has to be confirmed and approved beforehand, so that all the requirements are met for the production. This is to ensure that all locations have been checked for flight safety (airspace, ground space etc) and determines the quote given for my services.
